Kingsport residents file federal lawsuit against Domtar over odor

GREENEVILLE — Two Kingsport residents have filed a federal lawsuit against Domtar Corp., alleging odor from the company's containerboard recycling mill have kept them from fully using and enjoying their property and engaging in outdoor activities. Both residents, Scott Enochs and Tammy Williams, say noxious odors coming from the mill force them and other residents to remain inside, unable to use their yards, porches, other outdoor spaces or keep windows and doors open, according to court documents. The lawsuit also alleges the odor has devalued property by the mill and that Domtar has been negligent in mitigating odor from its mill and wastewater treatment operations. The lawsuit alleges more than $5 million in damages. It seeks to represent all property owners and people who live within two miles of the facility, estimating around 10,800 households are in that area. The lawsuit also cites complaints submitted to the city of Kingsport and directly to Domtar about the odor as early as April 2024. Domtar's Kingsport mill converted from producing sheet paper to recycling containerboard in 2023. Residents and city officials have complained about rotten egg-like odors coming from the mill since then. The company is in the process of constructing a new system to treat its wastewater, which it says will help mitigate the odor. In a statement to Six Rivers Media, the company said it does not comment on litigation.
